As Altman has promised, the confusing menu will be abstracted away from the user.39 The product will become a single, unified “ChatGPT” (powered by GPT-6, etc.) that intelligently routes user tasks to different-sized models in the background, balancing speed and “reasoning” as needed.
The “Agent” is the Product: The product’s primary interface will shift from chat to action. The “agent mode” (currently seen in experiments like ChatGPT Atlas 1) and the “Agent Builder” 3 will become the core product. The goal is an AI that moves from answering questions to performing multi-step, complex tasks on the user’s behalf.
“Discovery-as-a-Service”: The high-end, high-margin enterprise product, aligned with the new “Inevitable Utility” brand, will be marketed to scientists, researchers, and corporations as an engine for “AI-driven discovery”.33 This fulfills the AGI “hopium” 29 by positioning the product as a tool that can “figure out novel insights” 30 and solve humanity’s biggest problems.
Conclusion: A Framework for Response by Civil Society, Privacy, and Human Rights Organizations
OpenAI’s strategy of “calculated defiance” is working. It is successfully normalizing a high-velocity, high-risk deployment model by overpowering critics with market adoption and a compelling, messianic narrative. The traditional advocacy response—reacting to harms after they occur—is failing. A new, two-pronged strategic framework is required.
Section 6.1: The Fallacy of Reactive Regulation
The current model of advocacy is “reactive.” It sues after a death 13, decries bias after a model’s release, and publishes critiques after a harmful product (like Sora 2) is launched.19 This approach is “fundamentally flawed” 40 and destined to fail.
This “reactive modality” fails for three reasons:
Speed: The technology’s deployment (to 800M users) is too fast for legal or regulatory systems to keep up.
Opacity: The technology (a “black box” 41) is too opaque to prove intent to harm, a requirement for many legal challenges.
Incentives: It allows companies like OpenAI to treat these harms (lawsuits, fines) as a “cost of doing business,” a rounding error on the path to market dominance. It never challenges the root cause of the harm: the inputs and design of the system.40
Section 6.2: A Proactive Policy Framework (The “Shift Left” Strategy)
Civil society, privacy, and human rights organizations must force regulation to “shift left”—moving from punishing outcomes to regulating inputs.
Recommendation 1: Mandate “Disparate Impact” Liability. This is the single most critical and powerful legal tool. As advocated by the Brookings Institution 41, Congress and other legislative bodies must pass a new, broad disparate impact law specifically for AI.41 This doctrine makes discriminatory outcomes illegal, even without proving discriminatory intent. This is the only way to hold a “black box” algorithm accountable. It creates the “right incentives” 41 for OpenAI to aggressively audit its own models for bias before release, as they, not the victims, would bear the legal burden of proving their model is not discriminatory.
Recommendation 2: Mandate Pre-Release, Third-Party Audits. Regulators must move beyond “trust-us” governance. Civil society must advocate for policy (like the EU AI Act) that mandates rigorous, independent, third-party audits for bias, safety, and psychological manipulation before a “frontier model” can be publicly released.40
Recommendation 3: Embed Human Rights in National AI Strategies. Advocacy groups must lobby to ensure that human rights experts, child safety advocates, and civil society organizations are included in the drafting process of all national AI strategies, not just as a token consultation group.42
Section 6.3: A Reactive Advocacy Framework (The “Hold the Line” Strategy)
While proactive policy is the long-term goal, a smarter reactive strategy is needed to manage present-day harms.
Recommendation 1: Target Data & Privacy Hypocrisy. OpenAI’s most “defiant” PR move was its “privacy defender” pivot against the NYT.1 This is its greatest vulnerability. Advocacy groups must aggressively publicize the company’s actual privacy policies. Using the NNEDV’s warning 17 (that “deleted chats” are retained and weaponizable) to publicly dismantle the “privacy defender” narrative is essential. This exposes the hypocrisy and erodes the user trust that OpenAI’s “Meta-fication” strategy depends on.
Recommendation 2: Support “Right to Warn” and Whistleblowers. The “Right to Warn” letter from former OpenAI and Google employees 21 is a critical vulnerability. It is proof that internal, expert-level dissent exists and that companies are “prioritizing financial gains” over safety.21 Civil society must create robust legal and financial support systems for these internal dissenters. They are the only source of information on the internal risks the company is actively hiding.
Recommendation 3: Strategic Litigation. Continue to fund and support the NYT(copyright) and SMVLC (product liability) 9 lawsuits. The goal of this litigation is not just financial damages, but to establish legal precedent. Specifically, these cases must establish that (a) AI models are products and subject to standard product liability law, and (b) training data is not “fair use,” thereby forcing a new, more equitable commercial relationship with creators.
Section 6.4: The Consequences of Inaction
Failure to counter OpenAI’s “calculated defiance” is not a neutral outcome. It is a decisive win for their strategy of “normalization through acceleration.” The consequences will be severe and irreversible.
Entrenchment of Systemic Bias: As warned by the Brookings Institution 41 and others 40, inaction will allow algorithmic bias in hiring, credit, criminal justice, and healthcare to become systemic, permanent, and—due to their “black box” nature—immune to legal challenge.
Erosion of Truth and Autonomy: The “manipulation and misinformation” 21 enabled by these tools will rapidly overwhelm civil society’s and human rights organizations’ ability to “fact-check and verify content” 44, leading to what OpenAI itself calls societal-scale “shifts in dominant values”.45
Abdication of All Oversight: The original “non-profit” 46 safety teams and boards that were supposed to provide oversight have been systematically dismantled, co-opted, or fired.46 If civil society and human rights organizations do not fill this vacuum, no one will. Oversight of the most powerful technology in human history—one with self-admitted “extinction-level” risks 21—will be fully and permanently abdicated to a handful of “Meta-fied,” commercially-driven entities that have a documented public record of prioritizing speed, profit, and “enjoyment” over human safety.
